Agreement to Terms

By accessing or using byeusa.io ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

Description of Service

byeusa.io is a migration orchestrator that helps users move from US-based services (primarily Google) to European alternatives (Proton, Fastmail, etc.) through a controlled, phased 90-day migration process.

The Service includes:

• Service discovery and inventory scanning
• Email migration to target providers
• Account update checklists and guidance
• Migration progress tracking and timeline
• Optional data cleanup after migration

Account Registration

OAuth Authentication

To use the Service, you must authenticate via OAuth (currently Google OAuth). By connecting your account, you grant us permission to:

• Read your email content for service discovery and migration purposes
• Access your Google account metadata (name, email address)
• Perform migrations on your behalf to target services

Account Security

You are responsible for:

• Maintaining the security of your OAuth credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

Account Termination

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms, without notice.

Acceptable Use

You Agree NOT To

• Use the Service for any illegal purpose
• Abuse, harass, or harm other users
• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service or servers
• Use automated tools to access the Service without permission
• Reverse engineer or attempt to extract source code
• Resell or redistribute the Service without authorization
• Use the Service to spam or send unsolicited communications

Data and Privacy

Your Data

You retain all rights to your data. By using the Service, you grant us a limited license to process your data solely for the purpose of executing migrations and providing the Service.

Our Obligations

We commit to:

• Process your data only as necessary for migration purposes
• Delete temporary migration data within 7 days of completion
• Not sell, share, or use your data for advertising
• Implement reasonable security measures to protect your data

Limitations and Disclaimers

Service Availability

The Service is provided "as is" and "as available." We do not guarantee:

• Uninterrupted or error-free operation
• 100% accurate service detection
• Successful migration to all services
• Compatibility with all third-party services

Third-Party Services

We facilitate connections to third-party services (Proton, Fastmail, etc.) but are not responsible for:

• Their availability, performance, or policies
• Data loss or errors caused by third-party services
• Changes to their APIs or terms of service

Beta/Early Access

The Service may be offered in beta or early access. During this period, features may change without notice, and data may be reset. We will communicate any significant changes in advance.

Liability and Indemnification

Limitation of Liability

To the maximum extent permitted by law, byeusa.io and its operators shall not be liable for:

• Data loss during migration (you should maintain backups)
• Service interruptions or downtime
• Errors in service detection or migration
• Third-party service failures or data breaches
• Indirect, incidental, or consequential damages

Your Responsibility

You agree to:

• Maintain backups of important data before migration
• Verify migrations completed successfully
• Review and approve destructive actions (e.g., data deletion)

Indemnification

You agree to indemnify and hold harmless byeusa.io from claims arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

Intellectual Property

Service Ownership

byeusa.io, its design, code, and content are owned by the service operators and protected by copyright and intellectual property laws.

User Content

You retain ownership of your data and content. We claim no ownership rights to your data.

Feedback

If you provide feedback, suggestions, or ideas about the Service, we may use them without obligation or compensation to you.

Payment and Refunds

Pricing

Pricing details will be communicated when the Service launches. Currently, the waitlist is free. We reserve the right to change pricing with reasonable notice.

Refund Policy

Refund policies will be determined when paid features are introduced. We aim to be fair and reasonable in handling refund requests.

Termination

By You

You may terminate your account at any time by deleting it through the Service. Upon termination:

• Your account data will be deleted within 30 days
• OAuth tokens will be revoked immediately
• Temporary migration data will be deleted

By Us

We may terminate or suspend your account if:

• You violate these Terms
• You abuse the Service or other users
• Required by law or court order
• The Service is discontinued

We will provide reasonable notice before termination unless immediate action is required for security or legal reasons.

Changes to Terms

We may update these Terms from time to time. We'll notify you of significant changes via email or through the Service at least 30 days in advance.

Continued use after changes constitutes acceptance. If you disagree with changes, you should stop using the Service and delete your account.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and applicable national laws. Any disputes shall be resolved through good faith negotiation first.

Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and byeusa.io regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

No Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment

You may not assign these Terms without our consent. We may assign these Terms to any successor or affiliate.
